Eminent domain is when the government takes or condemns a property owner’s property. We make sure property owners are compensated for losing their property.
Commercial and Residential Leases
We assist property owners to draft and enforce leases for real estate. For residential properties, landlords must comply with the Plain Language Law. For commercial landlords, we can assist to make sure your lease correctly captures the obligations of the landlord and tenant.
Real Estate Purchase and Sales
We work with buyers (and their lenders) and sellers to purchase and sell real estate. We will review the status of the title to the property, make sure the taxes are paid current, and that the sale is done in compliance with local ordinances, such as the dye test and occupancy permit requirements.
For Sale By Owner or FSBO
Many times an owner may wish to try to sell his or her property without the assistance of a real estate agent. We work with buyers and sellers who are looking to sell their real estate without the assistance of a real estate agent. The first step in selling your house is to complete a seller disclosure statement. You must provide this to any buyer prior to signing an agreement of sale. You must also provide a lead based paint disclosure if your house is built prior to 1978. Zoning and Planning
We represent property owners before zoning board and planning commissions so they can use their property to their full enjoyment.
In situations where title insurance or a title search is not necessary, we can prepare a deed transferring your property. This typically would involve a transfer from parents to children. We can help guide you through the tax issues regarding gifting your house, and the potential capital gains that may be passed onto your children vs. the inheritance taxes that may be due if you were to retain title to your house. We also will ensure that all municipal requirements are satisfied as part of any deed transfer. This typically will include dye test and occupancy permits.
Real Estate Finance
We work with borrowers on commercial transactions to review and negotiate loan terms to finance the purchase of real estate or refinance property already owned by the borrower.
Oil and Gas
We can assist property owners to review a lease for gas rights on their property.
We can help property owners prevent a mechanics lien from being filed against their property, or if a mechanics lien is already filed, we can represent the owner in resolving the lien claim.
We are title agents for Old Republic National Title Insurance Company. We represent owners and lenders in the purchase of real estate and will issue a title policy to protect the owner and lender from claims or defects in their title.
